This auction is operated by Perryscope Productions (“Auction Organizer”) using a third-party online auction application. The Auction Organizer is the seller of record for all auction items.
Perryscope Productions is hosting the AC/DC Charitable Guitar Auction (“Auction”) under official license. All copyrights, trademarks, and related intellectual property associated with AC/DC remain the exclusive property of Leidseplein Presse B.V. and are used under license by Perryscope Productions.

Bidders must be at least 18 years of age at the time of participation. Bidders must create and maintain a registered user account in order to place a bid.
Participation in the Auction is void where prohibited by law. Bidders must not be located in, reside in, or participate from any restricted jurisdiction identified in these Terms.
The Auction Organizer reserves the right, in its sole discretion, to refuse, suspend, restrict, or disqualify any bidder or account at any time, including where participation may violate applicable laws, regulations, payment requirements, sanctions compliance, or these Terms and Conditions.

Each auction listing represents one (1) official AC/DC inflatable guitar signed by the band, as pictured and described on the auction website.
The inflatable guitars offered in this Auction are the same type of items that were sold in person at the official AC/DC PWR/UP Pop-Up events during the recent Australia tour.
The inflatable guitars are display collectibles and are not playable musical instruments. Each item is sold as a collectible, and minor variations in signature placement or appearance may occur.
The Auction opens on January 8 at 9:00 AM Eastern Time through January 15 at 6:00 PM Eastern Time.
All times are governed by Eastern Time (ET) and the auction platform’s system time, which shall be final and controlling. Once an auction is marked closed, the result is final.

All bids placed in this Auction constitute legally binding and enforceable offers to purchase the listed item.
By placing a bid, the bidder represents and warrants that they have the legal capacity and financial ability to complete the purchase if they are the winning bidder.
Bids may not be withdrawn, canceled, or modified once submitted for any reason.
Each new bid must meet or exceed the minimum bid increment specified on the auction page.
The highest valid bid recorded at the official close of the Auction will be deemed the winning bid. The auction platform’s system time and bid records shall be the sole and final authority in determining bid order, timing, and winning status.
In the event of a dispute regarding bid timing, validity, amount, bidder identity, or bid processing, the Auction Organizer’s determination shall be final and binding.
The Auction Organizer reserves the right, in its sole discretion, to void, reject, correct, or disqualify any bid or bidder that:

Appears to be fraudulent, manipulative, or made in bad faith

Results from technical error, system malfunction, or platform outage

Is placed by a bidder in a restricted jurisdiction

Is associated with unauthorized automated activity, scraping, or attempts to interfere with auction functionality
Bidding on behalf of another person or entity is prohibited unless expressly authorized in writing by the Auction Organizer. The Auction Organizer may require proof of authority.
The Auction Organizer is not responsible for missed bids due to bidder device issues, browser compatibility, connectivity problems, latency, time zone errors, or user error.
This Auction is a sale of goods by competitive bidding and is not a lottery, raffle, sweepstakes, or game of chance.

The winning bidder will be notified following the auction close.
Payment in full is required within forty-eight (48) hours of the winning notification.
Payment is not considered complete until funds have fully settled. Failed, reversed, declined, disputed, or charged-back payments will be treated as non-payment.
If payment is not completed or does not successfully settle within the required timeframe, the winning bid may be forfeited.
In the event of forfeiture, the item may be offered to the next highest bidder or relisted at the Auction Organizer’s sole discretion.
Payment must be made by the registered bidder using the payment methods presented at checkout. Split payments, third-party payments, wire transfers, or alternative payment arrangements are not permitted unless expressly approved in writing.
Failure to complete payment may result in account suspension and disqualification from future auctions.
Extensions, payment accommodations, or deadline modifications will not be granted except at the Auction Organizer’s sole discretion.
One Winner Limitation
Only one (1) item may be won per person and per physical shipping address for the duration of the Auction. Any attempt to circumvent this limitation through the use of multiple accounts, identities, payment methods, shipping addresses, or other means may result in disqualification, forfeiture of winning bids, cancellation of transactions, and account suspension, at the Auction Organizer’s sole discretion. The Auction Organizer reserves the right to verify identity and address information and to void excess winning bids and reassign items to the next highest eligible bidder.

International bidders are responsible for any currency conversion fees, foreign transaction fees, or exchange-related charges imposed by their financial institution. The Auction Organizer is not responsible for exchange rate fluctuations or related fees.

Sales tax will be collected where required based on the buyer’s shipping address and applicable sales tax nexus laws. The Auction Organizer will calculate and collect sales tax only in jurisdictions where it is legally required to do so.
For winning bidders located outside the United States, no U.S. sales tax will be collected. International winning bidders are solely responsible for all applicable customs duties, value-added tax (VAT), goods and services tax (GST), import taxes, use taxes, brokerage fees, and any other governmental charges imposed by the destination country or jurisdiction.
Where sales tax is not collected at checkout, bidders may have independent obligations to report and remit use tax or similar taxes to their local or state tax authorities. The Auction Organizer does not provide guidance on such obligations.
All customs declarations and shipping documentation will reflect the full winning bid amount as the declared value. Declared values will not be reduced, altered, or separated from the winning bid amount at the bidder’s request.
The Auction Organizer is not responsible for delays, fees, penalties, or additional charges resulting from customs processing, tax assessments, or regulatory requirements in the destination country.
Charitable support associated with this Auction does not automatically create a tax-deductible contribution. The Auction Organizer does not issue charitable tax receipts. Bidders are solely responsible for consulting their own tax advisors regarding any potential tax treatment, deductions, or reporting obligations related to their participation in the Auction.

Items will be shipped after payment has been received in full and successfully settled. All shipments will be insured.
Shipping timelines are estimates and may vary based on destination, carrier, customs processing, or force majeure events.
If a shipment is refused, returned, delayed, seized, or abandoned due to unpaid duties, taxes, customs fees, or regulatory issues, the winning bidder remains fully responsible for payment and no refund will be issued.
Risk of loss passes to the buyer upon shipment.

The Auction Organizer is facilitating this Auction in support of the above organizations and is not a charitable organization.
The Auction Organizer does not issue charitable tax receipts. Any charitable contribution associated with this Auction may not be tax deductible, and bidders are responsible for consulting their own tax advisors.
Charitable donations will be made following completion of the Auction and settlement of winning bids.

Opting out of marketing communications will not affect your ability to receive transactional communications or to participate in the Auction.
All communications are sent in accordance with applicable laws and regulations, including CAN-SPAM and, where applicable, the General Data Protection Regulation (GDPR).

Where practicable, affected bidders will be notified. The Auction Organizer shall not be liable for losses arising from such actions except where required by law.
