NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Giveaway Administrator

The AC/DC PWR/UP Pop Up Guitar Giveaway (“Giveaway”) is administered by:

Perryscope Productions LLC is referred to in these Official Rules as the “Administrator.”

This Giveaway is not sponsored, endorsed, administered by, or associated with any social media platform used to promote or announce the Giveaway.

2. Giveaway Period

The Giveaway begins when the first participating AC/DC PWR/UP Pop Up opens for entry and ends when the final participating AC/DC PWR/UP Pop Up closes on the final day of the AC/DC PWR/UP Tour (“Giveaway Period”).

Exact entry dates, locations and operating hours may vary. Entries must be submitted in person during the published operating hours of a participating AC/DC PWR/UP Pop Up.

The Administrator’s designated timekeeping system will be the official timekeeping system for the Giveaway.

3. Eligibility

The Giveaway is open to legal residents of the fifty United States, the District of Columbia and Canada who are at least 18 years old at the time of entry.

Employees, officers, directors, representatives, contractors and agents of Perryscope Productions LLC, AC/DC, their respective affiliates, participating venues, advertising and promotional agencies, prize providers, and members of their immediate families or households are not eligible to enter or win.

“Immediate family” includes spouses, parents, legal guardians, children, siblings and each of their respective spouses, regardless of where they reside.

The Giveaway is void where prohibited or restricted by law.

4. How to Enter

To enter, visit a participating AC/DC PWR/UP Pop Up during the Giveaway Period and complete the official entry form or other entry process provided at the location.

Entry is available in person only. No purchase, payment, concert ticket or pop-up purchase is required.

Participants may enter at as many participating AC/DC PWR/UP Pop Up locations as they choose. There is a limit of one entry per person, per participating pop-up location.

Visiting and entering at multiple participating pop-up locations will result in multiple eligible entries. Making a purchase will not provide an additional entry or improve a participant’s chances of winning.

Duplicate entries submitted by the same person at the same location, automated entries, entries submitted using false information, incomplete entries, illegible entries and entries submitted on behalf of another person may be disqualified.

All entries become the property of the Administrator and will not be returned.

5. Prize

One eligible winner will receive:

The exact guitar displayed at the AC/DC PWR/UP Pop Ups during the tour
The exact amplifier stack displayed with the guitar at the AC/DC PWR/UP Pop Ups
The guitar signed by Angus Young in Philadelphia on or around the final day of the tour

The winner will receive the actual guitar and amplifier stack displayed in person at the pop-ups, not replacement or replica items.

The approximate retail value of the complete prize is $3,000 USD.

Because the guitar and amplifier stack have been used as touring display pieces, they may show cosmetic wear, handling marks, aging or other signs of display, use and transportation.

The prize is awarded as is, without any express or implied warranty regarding its appearance, condition, merchantability, fitness for a particular purpose, functionality or suitability for professional or live performance use.

The placement, size, appearance and method of Angus Young’s signature will be determined solely by Angus Young and the parties coordinating the signing. No specific placement, inscription, personalization or signature style is guaranteed.

No cash alternative is available. The prize may not be transferred, assigned, sold or exchanged before it is awarded.

The Administrator reserves the right to substitute any portion of the prize with an item of equal or greater value if the advertised prize becomes unavailable due to circumstances beyond the Administrator’s reasonable control.

6. Winner Selection

One potential winner will be selected through a random drawing from all eligible entries received during the Giveaway Period.

The random drawing will take place on or around the final day of the AC/DC PWR/UP Tour, after the Giveaway Period has closed.

The odds of winning depend on the total number of eligible entries received across all participating pop-up locations.

The Administrator’s decisions regarding entry eligibility, winner selection and all other Giveaway matters are final and binding.

7. Canadian Skill-Testing Requirement

Before being confirmed as the winner, a potential winner who is a resident of Canada must correctly answer, without assistance and within a limited period of time, a mathematical skill-testing question administered by telephone, email or another method selected by the Administrator.

Failure to answer the question correctly within the permitted period will result in disqualification, and an alternate potential winner may be selected through another random drawing.

8. Winner Notification and Announcement

The potential winner will be contacted using the telephone number, email address or other contact information provided at the time of entry.

The potential winner’s name may be announced on official AC/DC PWR/UP Pop Up social media accounts and at pwruptour.acdc.com.

The potential winner will have five calendar days from the date and time of the Administrator’s first notification attempt to respond and claim the prize.

The potential winner may be required to:

Confirm eligibility
Provide valid government-issued identification
Provide proof of legal residency
Sign an affidavit or declaration of eligibility
Sign a liability and publicity release
Complete any required tax documentation
Provide a valid delivery address
Correctly answer a mathematical skill-testing question if the potential winner is a Canadian resident
Complete any additional documents reasonably required to award and deliver the prize

The potential winner will not be considered the confirmed winner until eligibility has been verified and all requested documentation and requirements have been completed.

If the potential winner does not respond within five calendar days, cannot be contacted, is found to be ineligible, declines the prize, fails to correctly answer the required skill-testing question, fails to complete the required documents on time or otherwise fails to comply with these Official Rules, the potential winner will be disqualified.

If a potential winner is disqualified, an alternate potential winner may be selected through another random drawing from the remaining eligible entries.

The same five-calendar-day claim period and eligibility requirements will apply to any alternate potential winner.

9. Prize Delivery

The Administrator will pay for standard delivery of the prize to one valid residential or commercial address within the United States or Canada.

The delivery date and method will be determined by the Administrator based on the winner’s location, freight requirements and the availability of the prize following the Philadelphia signing.

The winner is responsible for:

Providing complete and accurate delivery information
Ensuring that the delivery location can safely accept the guitar and amplifier stack
Being present or arranging for an authorized adult to accept and sign for the delivery
Any upgraded, expedited, specialized, international, remote-area, installation, storage or redelivery charges requested or caused by the winner
Any customs, import, brokerage or similar charges that may apply to delivery in Canada, unless the Administrator agrees otherwise in writing

The Administrator is not responsible for delays caused by freight providers, customs processing, weather, transportation disruptions or other circumstances beyond its reasonable control.

Risk of loss will transfer to the winner upon confirmed delivery of the prize.

10. Taxes and Other Expenses

The winner is solely responsible for all federal, state, provincial, territorial, local and other taxes associated with accepting or receiving the prize.

The winner is also responsible for any expenses not expressly included in the prize description, including installation, electrical work, storage, insurance, maintenance and costs associated with using, transporting or displaying the prize.

The Administrator may issue the winner any tax forms required by law. The winner may be required to provide a taxpayer identification number or other information necessary for tax reporting before the prize is released.

11. Public Announcement and Publicity

Except where prohibited by law, acceptance of the prize constitutes permission for the Administrator and its authorized partners to use the winner’s name, city, state, province or territory of residence, photograph, likeness, voice, statements and prize information for advertising, publicity and promotional purposes in any media worldwide without additional notice, approval or compensation.

The winner may be asked to participate in reasonable photography, video or publicity relating to the Giveaway, the signing of the guitar or the presentation and delivery of the prize.

The winner’s full street address, telephone number and email address will not be included in the public winner announcement.

12. Personal Information

Information collected in connection with the Giveaway will be used to:

Administer the Giveaway
Verify participant eligibility
Conduct the random drawing
Contact the potential winner
Announce the confirmed winner
Coordinate delivery of the prize
Comply with legal, regulatory and tax obligations

Any optional consent to receive marketing communications must be presented separately and is not required to enter or win.

By entering, participants acknowledge that the confirmed winner’s name and general place of residence may be publicly announced as described in these Official Rules.

13. General Conditions

The Administrator reserves the right to disqualify any participant who:

Provides false, incomplete or misleading information
Tampers with or attempts to manipulate the entry or drawing process
Submits entries through fraudulent or unauthorized means
Submits more than one entry at the same participating pop-up location
Interferes with the fair administration of the Giveaway
Violates these Official Rules
Acts in an abusive, threatening or disruptive manner toward pop-up personnel, the Administrator or other participants

The Administrator reserves the right to cancel, suspend, extend, delay or modify the Giveaway if fraud, technical failure, venue cancellation, tour schedule changes, transportation issues, artist availability, force majeure, government action, public-health concerns or any other circumstance beyond the Administrator’s reasonable control affects the integrity, safety or proper administration of the Giveaway.

If the Giveaway is terminated before the scheduled closing date, the Administrator may select the winner from eligible entries received before the termination, where permitted by law.

The Administrator is not responsible for lost, late, incomplete, damaged, illegible, misdirected or incorrectly recorded entries, or for failures involving equipment, software, internet service, telephone service, venue operations, freight providers or human error.

14. Release and Limitation of Liability

To the fullest extent permitted by law, each participant agrees to release and hold harmless Perryscope Productions LLC, AC/DC, their respective members, employees, representatives, affiliates, partners, participating venues, advertising agencies, prize providers and agents from claims, damages, losses, liabilities or injuries arising from:

Participation in the Giveaway
Acceptance, possession, delivery, transportation, installation, display, use or misuse of the prize
Any defect, damage or condition affecting the guitar or amplifier stack
Any electrical, installation, operational or safety issue associated with the prize
Any Giveaway-related activity
The use of the winner’s name, likeness, voice or statements as permitted by these Official Rules

Nothing in these Official Rules excludes or limits liability that cannot legally be excluded or limited.

15. Disputes and Governing Law

Except where prohibited by applicable law, the Giveaway and these Official Rules will be governed by the laws of the State of New York, without regard to its conflict-of-law principles.

Any dispute arising from or relating to the Giveaway must be brought individually, without resort to a class action, in an appropriate state or federal court located in New York County, New York.

Where permitted by law, participants waive claims for punitive, incidental, consequential or multiplied damages. Any recovery will be limited to actual out-of-pocket costs directly associated with entering the Giveaway.

Residents of jurisdictions that do not permit certain limitations or waivers will retain any rights that cannot legally be waived under the laws applicable to them.

16. Winner’s Name

The confirmed winner’s name will be posted at:

pwruptour.acdc.com

The winner’s name may also be announced through official AC/DC PWR/UP Pop Up social media accounts after the winner has been contacted, confirmed as eligible and completed all required documentation.
